Custom Design Agreement

Last Updated: October 5, 2026

At The Vinyl Tee Co., custom means we’re making something just for you—which is pretty great. It also means there are a few things we need to agree on before the creative work begins.

This Custom Design Agreement (“Agreement”) applies to custom artwork, graphic design, apparel designs, and other custom design services provided by The Vinyl Tee Co. (“we,” “us,” or “our”).

By submitting a custom design request and agreeing to this Agreement, you (“customer,” “you,” or “your”) acknowledge and agree to the following terms.

1. Custom Design Requests

Submitting a custom design request does not guarantee that The Vinyl Tee Co. will accept the project.

We reserve the right to decline any project at our discretion, including requests that we reasonably believe may violate applicable law, intellectual property rights, our business policies, or the rights of another person or business.

Project pricing, scope, expected turnaround time, included revisions, and other applicable details may be provided after we review your request.

2. Customer-Supplied Artwork, Images & Content

You may provide photographs, artwork, logos, graphics, text, names, trademarks, or other materials for use in your custom design.

By submitting those materials, you represent and confirm that you either:

Own the material; or

Have permission, authorization, or the appropriate license to use the material for the requested purpose.

You are responsible for obtaining any necessary permissions, licenses, releases, or authorizations before submitting materials to The Vinyl Tee Co.

The Vinyl Tee Co. is not responsible for determining ownership of customer-supplied materials or independently verifying that you have permission to use them.

To the extent permitted by law, you agree to be responsible for claims, damages, losses, or expenses resulting from materials you supplied or specifically instructed The Vinyl Tee Co. to use without appropriate authorization.

3. Copyrighted & Trademarked Material

Submitting copyrighted or trademarked material does not guarantee that we will reproduce it.

The Vinyl Tee Co. reserves the right to decline requests involving third-party artwork, characters, photographs, logos, trademarks, brand names, music-related imagery, or other protected material if we reasonably believe the requested use may infringe another party’s rights.

A customer’s statement that material was found online, purchased elsewhere, is available through a search engine, or is intended for personal use does not necessarily establish permission to reproduce it.

4. Design Fees & Payment

Custom design work requires creative time regardless of whether the customer ultimately uses the finished design.

Any applicable design fee will be communicated before work begins.

Unless otherwise agreed in writing, payment of the required design fee or deposit indicates authorization for The Vinyl Tee Co. to begin the project.

Once design work has begun, design fees are non-refundable, except where otherwise required by law.

Payment for design services does not automatically include the cost of printed merchandise unless specifically stated.

5. Revisions

The number of revisions included with a custom design will be communicated as part of the project details or pricing.

A revision means a reasonable modification to the existing design concept. A request for an entirely different concept, substantial change in direction, or restart of the project may be considered new design work and may require an additional fee.

Additional revisions beyond those included in the project may also require additional charges.

We will notify you before performing work that will result in an additional charge.

6. Customer Communication & Abandoned Projects

Timely customer responses help us keep custom projects moving.

If we request information, feedback, approval, or other materials needed to continue a project and do not receive a response, the project may be placed on hold.

Projects with no customer response for 30 days may be considered inactive or abandoned.

Design fees already paid for work performed are not refundable because a project becomes inactive or is abandoned by the customer.

If you return after a project has been closed, additional fees may apply to restart the project.

7. Proofs & Final Design Approval

Before a custom design is produced, you may be provided with a digital proof or mockup for approval.

You are responsible for reviewing the proof carefully.

This includes checking:

Spelling and grammar

Names and dates

Numbers and other information

Design elements

General layout

Requested wording

Design placement

Other visible details

Once you provide final approval, you authorize The Vinyl Tee Co. to proceed based on the approved version.

The Vinyl Tee Co. is not responsible for customer-approved errors that were visible in the final proof.

Changes requested after final approval may result in additional fees and may not be possible once production has begun.

8. Digital Proofs vs. Finished Products

Digital mockups are intended to provide a reasonable representation of the finished design.

Colors may vary between computer monitors, phones, printers, transfers, inks, garments, and other materials.

Print size and placement may also vary slightly during production.

Reasonable differences in color, positioning, sizing, or appearance between a digital proof and a finished physical product are not considered defects.

9. Ownership of Custom Designs

Unless otherwise agreed in writing, The Vinyl Tee Co. retains ownership of the original artwork and design work created by The Vinyl Tee Co., including applicable copyrights and intellectual property rights.

Payment for custom design services compensates The Vinyl Tee Co. for the creative services provided and does not automatically transfer copyright or complete ownership of the underlying artwork to the customer.

The customer receives the right to use the completed design for the purpose specifically agreed upon as part of the project.

The customer may not sell, sublicense, redistribute, reproduce for resale, provide the design to another printer or manufacturer, or use the design for additional commercial purposes unless those rights have been expressly granted by The Vinyl Tee Co. in writing.

If a customer wants broader commercial-use rights, production rights, source files, or ownership of an original design, those rights may be discussed separately and may require an additional licensing or ownership fee.

10. Customer-Owned Materials Remain Customer-Owned

The Vinyl Tee Co. does not claim ownership of artwork, photographs, logos, trademarks, or other original materials that you owned before providing them to us.

If we incorporate your existing material into a custom design, you retain whatever rights you already held in that original material.

The Vinyl Tee Co. retains its rights in original creative work contributed by The Vinyl Tee Co., unless otherwise agreed in writing.

11. Portfolio & Promotional Use

Unless you request otherwise in writing before the project is completed, you grant The Vinyl Tee Co. permission to photograph or display completed custom work for reasonable business-promotional purposes, including our website, portfolio, product examples, or marketing materials.

We will not intentionally publish private customer information as part of such use.

If your project contains confidential, private, or sensitive material that should not be displayed publicly, please tell us before production.

12. Cancellation

If you cancel a project before design work begins, any refund eligibility will be determined based on whether costs have already been incurred.

Once design work has begun, design fees are non-refundable.

Once a physical custom product has entered production, the order generally cannot be canceled, changed, returned, or refunded except in the case of an error by The Vinyl Tee Co. or where otherwise required by law.

13. Custom Product Returns

Because custom and personalized merchandise is produced specifically for the customer, custom products are generally final sale.

Customer-approved designs, incorrect customer-provided information, incorrect sizes selected by the customer, or a change of mind are not considered production errors.

If The Vinyl Tee Co. produces an item incorrectly compared with the approved design or order specifications, please contact us so we can evaluate the issue and provide an appropriate resolution.

Our separate Refund & Return Policy also applies.

14. Turnaround Times

Any design, production, or delivery timeframe provided for custom work is an estimate unless we expressly agree otherwise in writing.

Turnaround times may be affected by the complexity of the project, customer response time, revisions, product availability, shipping carriers, supply delays, holidays, weather, or other circumstances outside our reasonable control.

15. Right to Refuse or Discontinue a Project

The Vinyl Tee Co. reserves the right to refuse or discontinue a project when reasonably necessary, including projects involving unlawful material, suspected intellectual property infringement, harassment or abusive conduct, fraud, nonpayment, or requests outside the agreed scope of work.

If we discontinue a project for reasons unrelated to customer misconduct after payment has been made, we will determine an appropriate resolution based on the work already completed and applicable law.

16. Limitation of Liability

To the fullest extent permitted by applicable law, The Vinyl Tee Co. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from custom design services or products.

To the fullest extent permitted by law, The Vinyl Tee Co.’s aggregate liability arising from a custom design project will not exceed the amount actually paid to The Vinyl Tee Co. for the product or service giving rise to the claim.

Nothing in this Agreement limits liability or consumer rights that cannot legally be limited or waived.

17. Relationship to Our Other Policies

This Custom Design Agreement works together with The Vinyl Tee Co.’s Terms & Conditions, Refund & Return Policy, Privacy Policy, and Shipping Policy, as applicable.

If specific written project terms provided by The Vinyl Tee Co. conflict with this Agreement, the specific project terms will control for that project to the extent of the conflict.

18. Agreement

By checking the agreement box on our Custom Design request form, you acknowledge that you have had the opportunity to review this Custom Design Agreement and agree to its terms.

You also confirm that the information you provide is accurate and that you own or have permission to use the materials you submit.
